Besides the environmental administrative aspect, there is also a modern
and innovative environmental legislation, emphasizing the article 50 of
its Constitution: “The State will look for the well-being of all the
inhabitants of the country, organizing and stimulating the protection and
more adequate riches division. Everybody has the right of a healthy
environment and ecologically equilibrated. The State will guarantee,
defend and preserve this right and the law will determinate the
responsibilities and the sanctions” (changes in 1994).
The Forestall Code is
from 1996, having modern management and protection rules.
The Law nº 7.554/ 95 (Environment
Organic Law) makes possible the inhabitants and environment organizations
participation, creates Environmental Regional Councils, foments the
environmental culture for sustainable development, institutes the
environmental impact evaluation and defines the protected wild areas,
besides ruling the air, water, soil, energetic resources and the
ecological agriculture, creates the Environmental National Council and
Administrative Environmental Court, beyond another things.
