Rights and types of action
Consumers possess basic rights that are enumerated and protected in the Consumer Defense Code. Let’s see:
a) Life and health protection;
b) education for consumption;
c) choice of products and jobs;
d) information;
e) protection against deceiving and abusive advertising;
f) contractual protection;
g) indemnity;
h) access to justice;
i) facilitation of defense of their rights
j) quality of the public jobs;In the terms of the article 81, caput of the Consumer Defense Code, the defense of the interests and rights of the consumers and the victims could individually be exerted in judgment, or by the collective heading.
The individual actions will have to be proposed by lawyers to be contracted for the wronged consumer, and he will be able to make use on diverse subjects, as obligation, action for indemnification etc.
In the case of actions that tutor the collective interest, who have legitimacy for its proposal is the Prosecution Counsel, Union, States, Cities and the Federal District; the public entities and agencies, direct or indirect management, still that without corporate entity, specifically destined to the defense of the interests and rights protected by the CDC and the legally constituted associations that has at least one year and that have included among their institutional finalities the defense of the interests and rights protected by the CDC.
The term for claiming of products or jobs will be of 30 days for product or non-durable job and of 90 days for product or durable job.
The Term of Guarantee and the custom bill must be demanded by the consumer. In the case of purchases that were done out of the commercial establishment, the consumer has the right of regretting the purchase or contract up to 7 days from the act of receiving the product or the signature of the contract.
